1. Acceptance of Terms
Welcome to BuildFlow Kenya ("Service", "Platform", "we", "us"). These Terms govern your use of our construction management software. By creating an account or using our Service, you agree to be bound by these Terms.
2. Description of Service
BuildFlow Kenya provides cloud-based construction management including:
- Project management and tracking
- Bill of Quantities (BOQ) management
- Digital takeoff and estimating tools
- Inventory and procurement management
- Subcontractor and payment management
- M-Pesa integration, NCA and KRA compliance features
3. User Accounts
To use our Service, you must create an account with accurate information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
You must be at least 18 years old to use this Service.
4. Subscription and Payments
Free Tier: Limited features, 1 project, local storage only
Professional (KES 5,000/mo): Full features, 10 projects, cloud sync
Enterprise: Custom pricing, unlimited projects, API access
Paid subscriptions are billed in advance. All fees are in Kenyan Shillings (KES). We accept M-Pesa, cards, and bank transfer.
5. User Responsibilities
You agree to:
- Use the Service only for lawful purposes
- Not share your account credentials
- Not attempt to hack or compromise the Service
- Comply with all applicable Kenyan laws
- Maintain proper backups of your critical data
6. Data Ownership
You retain ownership of all data you input into the Service. We do not claim ownership of your data. By using the Service, you grant us a limited license to store and process your data solely to provide the Service.
7. Intellectual Property
The Service, including its design, features, and code, is owned by BuildFlow Kenya and protected by intellectual property laws.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
9. Limitation of Liability
BuildFlow Kenya shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
